GN15-02: Private Easements for Water and Drainage Pipes.

The CLA is often consulted by members who become involved in the laying of pipes to serve houses, farms or other property. Some may be wanting to obtain permission from a neighbour, others may have been asked for their agreement by a third party.

This note is prepared to assist all parties. It sets out some background information, comments on the value of the right and specifies the basic details that should be incorporated in any agreement. For simplicity the person under whose land the pipe is to be laid is referred to as the owner and the person installing the pipe as the neighbour.
