This Guidance Note aims to illustrate the current legal position regarding the rights of navigation on tidal and non-tidal waterways in England and Wales and looks at the likely elements of a claim for new navigation rights based on immemorial user and steps that could be taken to strengthen the riparian owners position and to help resist such claims.
