GN21-24 Changes to Agricultural Tenancy Legislation in Wales

The purpose of this guidance note is to update members on recent legislative changes to agricultural tenancy legislation in Wales. The succession rules have been amended as of 1st September 2024. In addition changes have been brought in with effect from 15 July 2024 to both the Agricultural Tenancies Act 1995 (ATA) Farm Business tenancies (FBT) and the Agricultural Holdings Act 1986 (AHA), with regards to the new ability for a tenant to refer to arbitration or third party determination when landlord’s consent or variation of terms is required for the tenant to request or apply for financial assistance under the Agriculture (Wales) Act 2023 or in order to meet a statutory duty.
